Exercising the Rights of the Affected Parties

Under Section 14 of the Infotv., the affected individual has the right with regard to their personal data managed by the data controller and the data processor acting on its behalf or its mandate to:

  • Be informed about the facts related to the data processing before the initiation of the data processing (hereinafter: right to prior information),
  • Request access to their personal data and related information managed by the data controller (hereinafter: right to access),
  • Request the data controller to correct or supplement their personal data in certain circumstances outlined in this chapter (hereinafter: right to correction),
  • Request the data controller to restrict the processing of their personal data in certain circumstances outlined in this chapter (hereinafter: right to restrict processing),
  • Request the data controller to delete their personal data in certain circumstances outlined in this chapter (hereinafter: right to erasure).

The Data Controller should provide all pieces of information in a concise, transparent, comprehensible, and easily accessible form, using clear and simple language, especially when directed to children. This information should be provided in writing or by other means – including electronically when appropriate. Upon request, verbal information can also be given, provided that the person has properly verified their identity.

According to the law, the affected party has the right to request information about the processing of their personal data, and they can also request correction, restriction of processing, or deletion of their data (Infotv. Section 14). Requests of this nature (subject to statutory requirements) must be assessed as soon as possible, but no later than twenty-five days after submission, and the decision should be communicated to the affected party in writing or electronically if the request was made electronically. Information must be provided in an easily accessible and readable form, with a concise, clear, and understandable content as per Infotv. Section 15 (1).

The enforcement of the rights of the affected individual is free of charge, except when the affected party submits repeated requests regarding the same set of data within the same year. In such cases, if the data controller or the data processor acting on its behalf or its instruction lawfully disregards the requests for correction, deletion, or restriction of data processing, the individual might face costs.

If the Company has well-founded doubts about the identity of the natural person submitting the request, they may ask for additional information necessary for confirming the identity of the individual.

The Company compensates for any damages caused to another due to the unlawful processing of the affected party’s data or the breach of data security requirements, as well as for any violation of personal rights caused by the company or its data processor. The data controller is relieved of the obligation to compensate for damages and payment of damages if they prove that the damage or violation of the affected individual’s personal rights was due to an unforeseeable reason outside the scope of data processing. Similarly, they are not liable for damages if the damage arose from the intentional or seriously negligent behavior of the injured party.
